Clusterbox Terms of Service ("Terms")
These Terms form a binding agreement between you and the Clusterbox entity that provides the Services to you ("Clusterbox," "we," "us," or "our"). By creating an account, accessing, or using any Clusterbox Services, you agree to these Terms.
Definitions
Account: Your Clusterbox account and any associated Workspaces. Admin: A user with administrative permissions over a Workspace. Affiliate: Any entity controlling, controlled by, or under common control with a party. Applicable Law: All laws and regulations that apply to your use of the Services. Beta Features: Pre-release or experimental features labeled alpha, beta, preview, or similar. Channels: Third-party integrations you connect to the Services (e.g., Instagram, Facebook, WhatsApp). Customer: Your end customer, lead, or contact with whom you communicate via the Services. MAC: Monthly Active Contacts; unique contacts messaged or engaged in a billing month per the Pricing & Credits Policy. Message Credits: Bundled or add-on credits that offset eligible paid message categories, per plan. Services: Clusterbox's software, websites, mobile apps, APIs, documentation, and related support.
Use of the Services
You may use the Services only for lawful business purposes. You must not use the Services to send spam, conduct phishing, or violate any applicable platform policies (Meta, TikTok, etc.). You are responsible for all activity that occurs under your account.
Payments and Billing
You agree to pay all fees applicable to your chosen plan. Fees are billed monthly or yearly in advance. All fees are non-refundable except as required by law or as specified in our refund policy. We reserve the right to change pricing with 30 days' notice.
Intellectual Property
Clusterbox retains all intellectual property rights in the Services. You retain all rights to your content and customer data. By using the Services, you grant Clusterbox a limited license to process your data solely to provide the Services.
Termination
Either party may terminate this agreement at any time. Clusterbox may suspend or terminate your account for violation of these Terms. Upon termination, you may export your data within 30 days.
Limitation of Liability
To the maximum extent permitted by applicable law, Clusterbox's total liability for any claims arising from or related to these Terms is limited to the fees you paid in the 12 months preceding the claim.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Clusterbox is registered, without regard to conflict of law principles.
